What categories of data does Adb process and for what purposes?

We process the following categories of customer and supplier data: company name, legal form, registered office, legal representatives and contact persons (name, surname, e-mail address and telephone/fax numbers) and billing data.

Such data is stored and processed where necessary.

  • for the preparation and execution of a contract (including customer relationship management);
  • for billing purposes;
  • marketing purposes, promotional, commercial and advertising activities, such as sending material and advertisements connected with the products and/or services marketed by Adb, sending promotional emails and text messages and sending newsletters, ebooks, provided that they have not opposed the use of the data for commercial purposes

On what legal basis do we process data?

The legal basis for the processing of personal data is the General Data Protection Regulation (GDPR) and in particular:

  • Art. 6 (1) (b) of the GDPR, which permits processing for the purposes of entering into and performance of contracts;
  • Art. 6 (1) (f) GDPR, which allows processing for the protection of our legitimate interests, provided that there is no overriding interest of the data subject which prevents such processing.

We also process personal data based on the consent given by the data subjects. The data subjects may withdraw their consent at any time. This will not have retroactive effect. However, the withdrawal of consent will prevent us from further processing the data subject's personal data. The other regulations that allow data processing (Art. 6 (1) (b) and Art. 6 (1) (f) GDPR) will remain unaffected.

Who do we share the data you provide with? Where is personal data stored?

We share personally identifiable information with recipients within the Adb group who need to know that information in order to carry out their functions and obligations, and with third parties who process data on our behalf, such as service providers, who are bound by contracts required by data protection law, or to whom Adb must provide information in order to comply with its legal obligations. We also share personally identifiable information with Adb's business partners who provide products and services sold by Adb.

Personal data is stored on Adb servers in the European Union.

Are data transferred to recipients outside the European Union or the European Economic Area (i.e. so-called third countries) or to international organisations?

Personal data of customers/suppliers will be transferred to third countries only if necessary for the execution of the contract.

How long are the data provided to Adb kept?

We retain personal data only for the time necessary to achieve the purposes described above and then delete them, in any case they will be deleted in accordance with the retention periods established by law.

What are the rights of the Data Subject? Where can I lodge a complaint?

Article 15 of the GDPR provides the right to be informed about the data we hold about the subject.

In the presence of incorrect or outdated information, the subject has the right to request its correction at any time, pursuant to art. 16 of the GDPR.

Furthermore, pursuant to art. 17 of the GDPR, the subject may have the right to request the erasure of his/her personal data, in the absence of greater powers or rights on our part to continue the processing.

Finally, pursuant to art. 18 of the GDPR, the subject has the right to restrict/limit the processing of his/her personal data.

To obtain information regarding the data we possess, for their correction, deletion or for the restriction/limitation of the processing, contact the address indicated in point 1.

You may request that the information you provide to us be sent to you in a structured, commonly used and machine-readable format, or that we transmit this information to a third party.

Is sharing or updating data mandatory?

Providing your data is a free choice. However, we are authorized to process the personal data of the subjects with whom we have contractual or pre-contractual relationships, to prepare and execute contracts and for invoicing purposes.

Are the personal data provided used for automated decision-making processes?

In principle, we do not use customer/supplier data for automated decision-making as described in Art. 22 GDPR.

According to Art. 21 (1) GDPR, the data subject has the right to object to the processing of his or her personal data at any time in the event of a particular situation. In the event of an objection, we will stop processing the personal data unless we demonstrate compelling legitimate grounds for the processing that outweigh the interests of the data subject (e.g. for the enforcement or defense of legal claims).

  1. Right to object to processing for commercial purposes:

Pursuant to Art. 21 (2) GDPR, the data subject also has the right to object to processing for direct marketing purposes. In such a case, we will stop using the personal information received for marketing purposes.

Protecting your personal information is of primary importance to us. We will use the identifying information that you choose to provide to us, or that is otherwise collected during your use of the website, only as described in this Online Privacy Policy and in accordance with applicable data protection laws.

The competent authority for data protection is the Guarantor for the protection of personal data www.garanteprivacy.it . If the user considers that the data processing carried out by us does not comply with this Online Privacy Policy or with the laws and regulations in force, he/she may file a complaint with the Guarantor for the protection of personal data. For completeness in certain circumstances, as provided for by art. 157 of Legislative Decree no. 196/2003 (not subject to the normal management of the site), Adb must transmit information and updates to the competent authorities for the verification of the processing of personal data. We have a legitimate interest in processing this data anonymously as it allows us to improve and develop our site. We are in no way interested in identifying the user who visits our site. The data collected in this way will not be associated in any way with any identifying information of the user from any other source.

  1. c) Newsletter and commercial offers

Our website offers the user the possibility to download and/or register to receive commercial offers sent by us or our newsletter (hereinafter “newsletter”). To register, the user must enter a valid e-mail address. When registering for commercial offers or the newsletter, the IP address, date and time will be saved in our archives. This serves to protect us in the event that a third party uses the user's e-mail address inappropriately and without consent to register for our commercial offers/newsletter. No other data will be collected. The data collected in this way is used only for the purpose of sending the user commercial offers or newsletters. The data is not transferred to third parties and is not combined in any way with any information collected on our website.   1. g) Use of Google Remarketing

This site uses the remarketing function of Google Inc. (see the address of Google Inc. reported in the previous point f). This function is designed to report commercial messages based on the user's interests through the Google promotional network. The user's browser will save Cookies that allow the user to be recognized on the sites that belong to the Google promotional network. These pages can show users promotional messages related to the contents previously visited by them on the sites that use the Google Remarketing function. Google declares that it does not collect any personal data in this process. The user can disable the Google Remarketing function from the page http://www.google.com/settings/ads.   1. h) Use of Hotjar

To improve your browsing experience on our websites, we use services and software from Hotjar Ltd. (Level 2, St Julian's Business Center, 3, Elia Zammit Street, St Julian's STJ 1000, Malta [AB1] , http://www.hotjar.com). Hotjar allows us to measure and evaluate user behavior on our website. The purpose is to improve your browsing experience, remember your preferences, solve technical problems, analyze trends and generally improve our website. For these purposes, Hotjar places cookies on visitors' devices to collect non-personal device and browser information (e.g. the IP address of the device in anonymized format, screen resolution, device type, operating system and browser type, country from which the site is accessed, language settings), user interactions (such as mouse movements, keyboard input, scrolling, etc.) and log data (such as pages visited, length of time spent on a page, referring URL and domain, date and time of access, etc.).
